This article seeks to interpret the striking divergence between the two judgments passed by the European Court of Human Rights in the Lautsi v Italy case in terms of value pluralism. The latter is a hotly debated position in ethics, brought to life in the second half of the twentieth century by Isaiah Berlin. Pluralism elucidates these in interesting ways. First, value pluralism sheds light on three major aspects of the trial before the European Court of Human Rights: the nature (...) of the collision of values, the discrepancy between the two decisions, and the rationale of the final judgment. Secondly, this is my thesis that while the first judgment fits ethical monism, which underlies Dworkin’s ‘one right answer’ theory, the second ruling chimes with pluralism. The pluralist spirit of the Grand Chamber’s final decision turned Europe away from the path of Americanization. (shrink)

Cerkveni očetje so bili v srednjeveških pridigah med najbolj pogosto navajanimi avtoritetami, takoj za Svetim pismom. Citati so se uporabljali na različne načine: kot eksegeza prebranega, kot komentar moralnega nauka ali kot močan argument za določeno izjavo. Hieronim je sodil v srednjem veku med najpomembnejše avtoritete, njegove odlomke in citate je najti v številnih zbirkah pridig. Prispevek predstavi recepcijo svetega Hieronima v zbirki pridig iz 15. stoletja, znani kot Sermones Discipuli de tempore et de sanctis cum Promptuario exemplorum et de (...) miraculis Beatae Mariae Virginis, ki jo je napisal nemški dominikanec Johannes Herolt (†1468). V tej zbirki so citati iz različnih Hieronimovih del, večinoma iz njegovih pisem. Kljub poudarku Hieronimovih besedilih analiza vključuje tudi odlomke iz t. i. psevdo-Hieronima. (shrink)

Harry Frankfurt's famous examples of overdetermined moral agents who are nevertheless responsible for their actions and omissions have long been hailed as proofs that the ability and/or opportunity to do otherwise is not a necessary condition for moral responsibility. In this paper I use recent clarifications of some of these examples by Frankfurt himself to show that their force relies in part on tacit ceteris paribus assumptions concealing a reliance on PAP that concerns matters of fairness in assessing moral responsibility.

The policy adopted by the Twenty-fifth Congress of the CPSU on raising the quality of work and the effectiveness of social production means that work must be more highly organized and disciplined and that initiative and creative searching must be fostered. "The country sets as its goal enlargement of the real opportunities for citizens to apply their creative powers, abilities, and gifts and for comprehensive development of the individual.".

The "mathematization" of knowledge is a historically inevitable process governed by two circumstances. In the first place there is the need for the further extension of knowledge in all areas of human activity, whether it be the study of natural phenomena or the theory of taking decisions in the economic or social sphere. Marx pointed out long ago that a science reaches its highest levels only when it succeeds in making use of mathematics. The second circumstance rendering the process of (...) deepening and broadening the mathematization of knowledge not only necessary but possible lies in the constant development both of mathematics itself and of the technical means broadening the sphere of its application. The topic of consent in paediatrics is made more difficult, and at the same time more interesting, by the complexity of the issues involved and the consequent diversity of viewpoints. In a teaching session for senior medical students on consent in paediatrics it proved necessary to reinstate previous learning from a range of disciplines. Philosophical medical ethics, developmental psychology, communication skills and the appropriate legal definitions all contributed to a proper understanding of the cases presented. The two most important additional (...) components appeared to be a) a basic knowledge of cognitive development and how to apply it, and b) an awareness of the need to balance an individual child's rights or best interests, with those of the family unit, as well as the wider society. This paper presents findings from a longitudinal study of patient refusals (as reported by graduating medical students) to take part in the teaching function of public hospitals. Results from a smaller study of non-patients' attitudes are also reported. Findings are discussed in terms of patients' rights, issues of personal privacy, medical education, and the public good.
